A bipartisan bill to delay the federal hemp ban until December of this year has passed Congress and is headed to President Trump’s desk.
The new federal law will ban most hemp-derived THC products, impacting a $33 billion industry and local businesses.
Hemp-derived THC became federally legal in 2018, after the Farm Bill defined hemp as cannabis containing less than 0.3% delta-9 THC by dry weight, removing it as a Schedule I controlled substance and making it possible to sell it in gummies, edibles and drinks.
This created a loophole, allowing certain cannabis products with delta-8 or delta-10 to be sold and leading to an unregulated market.
In November 2025, Congress signed a bill capping the amount of THC in drinks, gummies and other infused products. This means most THC hemp products will be illegal to sell and manufacture.
